Store regulations


1. GENERAL PROVISIONS

1.1 The Online Store available at www.busybees.pl (hereinafter referred to as the Store) is run by Dawid Sierży (hereinafter referred to as the "Seller"), conducting business activity under the name Dawid Sierży Microlab (address of business address: ul. Wrocławska 66/D, 30-017 Kraków and correspondence address: ul. Wrocławska 66/D, 30-017 Kraków) entered into the Central Register and Information on Business Activity of the Republic of Poland, kept by the minister responsible for economy, Tax Identification Number (NIP) 6282050092, e-mail address: czesc@busybees.pl.
1.2 The party making purchases in the Store (hereinafter referred to as the "Customer") may only be an adult natural person or an organizational unit that is not a legal person, to which the law grants legal capacity or a legal person.
1.3 The condition for making purchases in the Store is that the Customer completes the order form and accepts the delivery terms (including delivery costs) included in the order.
1.4 Every person placing an order in the Store is obliged to read these Regulations.
1.5 The minimum technical requirements that must be met to cooperate with the IT system used by the Seller, including concluding the Sales Agreement and providing other electronic services, are: a computer/laptop/other multimedia device with Internet access; access to e-mail and a valid e-mail address as well as a standard Internet browser.

2. INTELLECTUAL PROPERTY RIGHTS

2.1 All goods offered in the Store are handmade and constitute unique products made on the basis of creative designs, the copyright to which belongs exclusively to the Seller or third parties.
2.2 Any copying, duplication, reproduction or imitation of the goods offered in the Store may constitute an infringement of the copyrights of the Seller or third parties.
2.3 All materials posted on the Store's website, such as photos, text, and graphics, are the property of the Seller. Their use without the Seller's consent is prohibited.


3. OFFER

3.1 Information about the Goods published in the Online Store, such as photos, descriptions, and prices, constitutes an invitation to enter into a sales contract within the meaning of Article 71 of the Civil Code, in accordance with the Terms and Conditions. The Seller makes every effort to ensure that the photos and descriptions of the goods presented on the Store's website are accurate. However, they may differ slightly from the product the Customer receives.
3.2 The prices of goods in the Store are gross prices (including VAT) and are given in Polish zlotys (PLN).
3.3 The prices of goods in the Store do not include delivery costs, which will be determined before placing the order depending on the delivery method chosen by the Customer.
3.4 The price binding on the Customer is the price given for the selected goods at the time the Customer places the order.

4. ORDERS

4.1 The Seller enables the conclusion of contracts for the sale of Goods via the Internet and provides other services provided for in these Regulations.
4.2 In order to register an Individual Account and to conclude a Sales Agreement via the Store's website, the Customer must have an active e-mail account.
4.3 Creating an Individual Account is not necessary to place an order in the Online Store.
4.4 The Customer may place orders in the Online Store via the Store's website 7 days a week, 24 hours a day.
4.5 To place an order, the Customer must select the Goods in the Store. Each Good must be added to the "Cart" using the "Add to Cart" option. The Customer can then continue selecting the Goods. After completing the entire order, go to the "Cart" and continue the ordering process. When placing an order, the Customer can log in to their Individual Account or complete the order as a "guest" by entering their personal information and delivery address in the appropriate fields. In the next steps, the Customer can select the delivery method and payment method. They are informed of the total price for the selected Goods and their delivery, as well as any additional costs they are required to incur in connection with the order. The Customer then places the order by selecting the "Complete purchase" option.
4.6 The condition for placing an order is acceptance of the Regulations and the Privacy Policy by marking the appropriate box in the order form.
4.7 Information provided by the Customer when placing an order must be truthful, current, and accurate. The Seller reserves the right to refuse an order if the information provided is so inaccurate that it prevents the order from being fulfilled, and in particular, prevents the proper delivery of the ordered Goods. Before refusing an order, the Seller will attempt to contact the Customer to obtain the necessary information.
4.8 Until the selection of Goods is confirmed by clicking the "Complete Purchase" button, the Customer can make changes and modifications to the Goods in the order, as well as to the shipping and billing contact information. Until payment is made, the Customer may discontinue placing the order by not continuing with the next steps. In such a situation, the Customer's order will not be fulfilled.
4.9 Placing an order by the Customer constitutes an offer by the Customer to the Seller to conclude a contract for the sale of Goods within the meaning of the provisions of the Civil Code.
4.10 After placing the order, the Seller sends an order confirmation to the e-mail address provided by the Customer.
4.11 The conclusion of the Goods Sales Agreement between the Seller and the Customer takes place upon the Customer receiving information about the acceptance of the order referred to in point 4.10. This information contains confirmation of the terms of the Sales Agreement concluded on the basis of the Regulations.


5. CREATING AN INDIVIDUAL ACCOUNT

5.1 To create an Individual Account, the Customer is required to register their data free of charge in the Store's database. Data registration is performed by completing the registration form available in the "Account" tab and selecting the "Register" option. Completing the form requires providing the following information: name, email address, phone number, and a personalized password.
5.2 The condition for creating an Individual Account is acceptance of the Regulations and the Privacy Policy by marking the appropriate box in the form.
5.3 After submitting the completed registration form, the Customer will immediately receive confirmation of the Seller's registration of the Individual Account in the Store, sent electronically to the email address provided in the registration form. At this point, an agreement is concluded for the electronic provision of the Individual Account service, and the Customer will be able to access the Individual Account and make changes to their data provided at the time of registration.

6. PAYMENTS

6.1 The price payable to the Seller together with any other fees payable to the Seller (including delivery fees) must be paid in one of the following ways:
a. Transfers 24
b. Applepay
c. PayPal.
6.2 In exceptional circumstances, the buyer may make a bank transfer no later than two business days after placing the order. The customer is asked to contact them by email to receive the bank transfer details.
6.3 If the payment is not credited to the Seller's bank account within the time limit referred to in point 6.2 above, the order will be canceled.
6.4 When making purchases in the Store, the Buyer accepts the use of invoices.

7. SHIPPING

7.1 The ordered goods are delivered by courier companies and Poczta Polska to the shipping address indicated in the order form.
7.2 Ordered goods are dispatched within 2 business days and delivered within a maximum of 7 business days.
7.3 The Seller is not responsible for re-sending goods that were returned due to the addressee's absence, change of residence and failure to notify the Seller of this fact or failure to collect the shipment from the post office within the specified time.


8. INFORMATION REGARDING THE EXERCISE OF THE RIGHT OF WITHDRAWAL FROM THE CONTRACT

8.1 Persons making a purchase in the Store who are consumers within the meaning of Article 221 of the Civil Code have the right to withdraw from the concluded sales contract within 14 days without giving any reason.
8.2 The period for withdrawal from the contract expires after 14 days from the day on which you came into possession of the goods or on which a third party other than the carrier and indicated by you came into possession of the goods.
8.3 To exercise the right of withdrawal, you must inform the Seller of your decision to withdraw from the contract by means of an unequivocal statement via e-mail to the following address: czesc@busybees.pl
8.4 In order to meet the withdrawal period, it is sufficient for you to send information concerning the exercise of your right to withdraw from the contract before the expiry of the withdrawal period.
8.5 If you withdraw from the entire contract, i.e. return the entire order, we will refund all payments received from you, including the costs of delivery (excluding any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us), immediately and in any event no later than 14 days from the day on which we are informed of your decision to exercise your right of withdrawal. We will make the refund directly to the bank account you indicated on the returns form.
8.6 The consumer bears the direct costs of returning the product.
8.7 The consumer must return the goods to the following address: Dawid Sierży Microlab, ul. Wrocławska 66/D, 30-017 Kraków no later than 14 days from the date of receipt of the order.
8.8 In the event of a partial return of an order, shipping costs will not be refunded.
8.9 The Buyer is responsible for any reduction in the value of the Product resulting from its use in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of such item.

9. COMPLAINTS

9.1 Any complaints, delays in delivery, possible non-compliance of the goods with the order and damage caused during transport should be reported immediately in writing to the following e-mail address: czesc@busybees.pl
9.2 Before accepting the shipment, the Customer is obliged to check the condition of the packaging in the presence of the courier.
9.3 If the shipment shows signs of damage, it should not be accepted and an appropriate protocol should be drawn up in the presence of the deliverer, a template of which is available to the deliverer.
9.4 Complaints will be considered within 14 business days from the date of receipt of the complaint.
9.5 If the complaint is accepted, the defective goods will be immediately repaired or replaced with new, full-value goods.
9.6 If the repair or replacement of the goods is not possible or is significantly difficult, the Seller – based on arrangements with the Customer – will refund the equivalent of the price of the goods or offer other goods available in the Store.
9.7 The costs of delivery of new or defect-free goods are borne by the Seller.

10. OTHER SERVICES PROVIDED ELECTRONICALLY

10.1 The Seller takes steps to ensure the proper functioning of the Store, to the extent that results from the current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
10.2 The Seller, in addition to enabling the conclusion of Sales Agreements via the Store in accordance with these Regulations, also provides the following services electronically to Customers free of charge:
a. Newsletter service,
b. Individual Account Service,
c. Product Availability Notification Service.
10.3 In order to commence the provision of the Newsletter service, the Customer must consent to receiving the Newsletter by entering his/her e-mail address in the appropriate field on the Store's website and confirming it by clicking on the activation link sent by the Seller to the e-mail address provided by the Customer (the moment of commencement of the Newsletter delivery service).
10.4 The Newsletter is provided free of charge for an indefinite period. The Customer may, at any time and without providing a reason, unsubscribe from the Newsletter (opt out of the Newsletter), in particular by clicking the deactivation link included in each Newsletter sent to the Customer via email, or by sending a relevant request to the Seller using the contact details provided, as well as by providing their email address in the "Unsubscribe from the Newsletter" field on the Store's website.
10.5 The Individual Account service is available after registering data in the Store's system on the terms described in point 5 of the Regulations and consists in providing the Customer with an individual panel in the Seller's IT system, allowing the Customer to use additional functionalities of the Store's website, such as modifying the Customer's data, maintaining the Customer's session after logging in to the Individual Account, storing and making the order history available to the Customer, and tracking the status of orders.
10.6 The Product Availability Notification Service is available after completing the appropriate field with your e-mail address.
10.7 The Customer is entitled at any time to request that the Store cease providing the services indicated in point 10.2. In such a case, the agreement for the provision of the Newsletter service or the Individual Account service, respectively, is terminated, and the Seller has 14 days to delete the Individual Account or remove the Customer's data from the database of individuals who have agreed to receive the Newsletter, subject to the principles of processing Customers' personal data contained in the "Privacy Policy" document, available on the Store's website under the "Privacy Policy" tab.


11. PERSONAL DATA PROTECTION

11.1 All information regarding the processing of personal data can be found in the Privacy Policy.

12. FINAL PROVISIONS

12.1 In matters not regulated by these Regulations, the relevant provisions of Polish law shall apply.
12.2 A Customer who is a consumer within the meaning of Article 221 of the Civil Code has the option of using out-of-court complaint and redress procedures before the Permanent Consumer Arbitration Court at the Provincial Inspectorate of Trade Inspection. Detailed rules for accessing these procedures are available at www.uokik.gov.pl in the "Resolution of consumer disputes" tab.
12.3 Opinions and questions regarding the presentation of goods and order fulfillment can be sent to the following e-mail address: czesc@busybees.pl.
12.4 These Regulations are effective from the date of their publication on the Store's website and each Customer may access the Regulations at any time via the "Regulations" link placed on the Online Store's website.
